Terms and Conditions
By accessing or placing an order through Bags Planet (https://promotionalbagsdirect.com.au), you (the "Customer") agree to the following terms. These conditions define the rights and responsibilities of both Bags Planet and the Customer in relation to the supply of our products and services. Bags Planet reserves the right to modify these terms at any time, with updates becoming effective immediately upon publication on our website.
Artwork Submission and Approval
The Customer must provide artwork that adheres to the specifications outlined on our website. Before production starts, Bags Planet will share a digital mockup for approval. It is the Customer's responsibility to carefully review and approve this mockup to ensure the accuracy of design and branding details, as production will proceed only after approval is confirmed.
Ordering and Communication
All orders must be submitted in writing, preferably via email, to avoid miscommunication. Clear instructions on product specifications, branding requirements, and delivery details are essential to ensure order accuracy.
Product Availability and Colour Matching
Bags Planet cannot guarantee continuous availability of all products, as items may be discontinued or become unavailable without notice. While we strive to match PMS colours accurately, slight variations may occur due to differences in material or printing surfaces.
Rush Orders and Urgent Processing
Additional fees may apply for orders that require expedited production or delivery. These orders will be prioritized based on capacity, but delays caused by third parties are beyond Bags Planet's control.
Quantity Variations in Custom Orders
Custom-branded orders may experience a quantity variation of ±5%. The final invoice will reflect the exact number of items supplied.
Shipping and Handling Fees
Freight and handling charges apply to all orders and are included in the final invoice. Bags Planet ensures timely and secure delivery but is not responsible for delays caused by external factors such as shipping disruptions.
Inspection of Goods
The Customer is responsible for inspecting all goods within seven days of receiving their order. Any defects or issues must be reported to Bags Planet in writing within this time frame. If applicable, defective goods should be returned in their original packaging, with return shipping costs covered by the Customer.
Ownership of Artwork and Intellectual Property
By submitting artwork to Bags Planet, the Customer grants us the right to use the artwork solely for the production and delivery of the order. We do not retain ownership of the artwork beyond the completion of the order.
Cancellations and Amendments
Once production has commenced, order cancellations will not be accepted unless otherwise agreed in writing. Any costs incurred up to the point of cancellation will be invoiced. Amendments to orders must be submitted in writing, and additional charges may apply depending on the changes required.
Late Payments and Debt Collection
Failure to pay by the due date may result in additional fees. Unpaid debts will be referred to a collection agency, and the Customer will be liable for any associated legal and recovery costs.
Liability and Consumer Protection
Bags Planet’s liability under the Competition and Consumer Act 2010 (CCA) is limited to replacement or refund, as required by law. We are not responsible for any indirect or consequential losses resulting from delays, third-party issues, or other factors beyond our control.
Warranty and Limitations of Liability
All implied warranties are excluded except those required by law. Where applicable, manufacturer warranties will be passed on to the Customer. Bags Planet’s liability is limited to refunding or replacing defective goods.
Payments
Unless otherwise agreed in writing, full payment is required before production begins. Goods remain the property of Bags Planet until payment is received in full. Accepted payment methods include direct bank transfers (with no additional fees) and credit card payments, which incur a 1.75% merchant fee for Visa, Mastercard, and American Express.
Refunds and Returns
If a product is found to be defective, the Customer must notify Bags Planet in writing within seven days of receiving the order. If approved for return, the goods must be in their original condition and packaging, and the Customer will cover return shipping costs. Bags Planet will assess the returned goods and provide either a replacement or refund as appropriate. Refunds will not be issued for custom-branded products unless the product is defective.
By placing an order with Bags Planet, the Customer acknowledges and agrees to these Terms and Conditions, confirming their rights and responsibilities as outlined by Australian consumer law.
